The American Chamber of Commerce in Bosnia and Herzegovina (AmCham BiH), with the support of the Center for International Private Enterprise (CIPE), has published the final first version of the Administrative Guide on the Application of Discretionary Grounds for Exclusion and Self-Cleaning Measures.
The Guide was developed through an analysis of the applicable legal framework, consultations with companies and relevant institutions, a private-sector survey, and focus groups. It is intended for contracting authorities, bidders, legal and compliance teams, public procurement professionals, and other stakeholders involved in public procurement procedures.
The publication provides guidance on the application of discretionary grounds for exclusion, evidentiary requirements, proportionality, self-cleaning measures, treatment of suspected prohibited agreements, and the roles of relevant institutions.
